Terms and Conditions for Personal Training and Nutrition Services
1. Acceptance of Terms
By accessing or using the services provided by hofML Health & Performance, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please refrain from using our services.
2. Services
The Trainer offers personal training and nutrition services through in-person sessions, online platforms, and other agreed-upon methods. The services may include fitness programs, nutritional guidance, and other related offerings.
3. Client Responsibilities
Clients are responsible for providing accurate health information and disclosing any medical conditions or concerns that may affect their ability to engage in fitness activities. Clients must follow the Trainer’s instructions and commit to the prescribed fitness and nutrition plans.
4. Payments and Refunds
Payment for services is due in advance unless otherwise agreed upon. The Trainer reserves the right to adjust pricing with notice. Refunds are not provided for completed services, but exceptions may be made at the Trainer’s discretion.
5. Scheduling and Cancellations
Clients must schedule sessions in advance and provide at least 24 hours’ notice for cancellations. Failure to cancel within the specified time may result in a charge for the session.
6. Confidentiality
All client information, including health records and personal details, will be kept confidential unless required by law. The Trainer may use anonymized and aggregated data for research or promotional purposes.
7. Intellectual Property
All materials provided by the Trainer, including workout plans, nutritional guides, and other resources, are the intellectual property of the Trainer and may not be reproduced or distributed without permission.
8. Liability
Clients engage in fitness activities at their own risk. The Trainer is not liable for any injuries or health issues that may arise during or after sessions. Clients are advised to consult with a healthcare professional before starting a new fitness or nutrition program.
9. Termination of Services
The Trainer reserves the right to terminate services if clients fail to comply with these terms and conditions or engage in behavior deemed inappropriate or unsafe, or for any other reason at the Trainer’s discretion. Additionally, the Trainer can terminate the agreement at any time.
10. Governing Law
These terms and conditions are governed by the laws of California. California consumers have the right to file complaints with the Consumer Relations Department located in Sacramento, California, under the jurisdiction of the California Department of Consumer Affairs.
By using our services, you acknowledge that you have read, understood, and agree to these terms and conditions. The Trainer may update these terms periodically, and it is the client’s responsibility to review them regularly for any changes.
